Supervisory Authority

The supervisory authority responsible for me or for complaints against me is Berliner Beauftragte für Datenschutz und Informationsfreiheit, Alt-Moabit 59-61, 10555 Berlin.

Collection, Processing, Use and Forwarding of Personal Data

a) When visiting the Website
When you access my Website www.cke.legal, information is automatically sent to the server of my Website by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

• IP address of the requesting computer,

• date and time of access,

• name and URL of the retrieved file,

• Website from which access is made (referrer URL),

• browser used and, if applicable, the operating system of your computer and the name of your access provider.

I process the aforementioned data for the following purposes:

• Ensuring a smooth connection setup of the Website,

• ensuring convenient use of my Website,

• evaluation of system security and stability, as well as

• other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. My legitimate interest follows from the purposes of data collection listed above. In no case do I use the collected data to draw conclusions about your person.

b) When using my contact form

For questions of any kind, I offer you the opportunity to contact me via a form provided on the Website. In this case, it is necessary to provide a valid email address so that I know who the inquiry is from and to be able to answer it. Further information can be provided on a voluntary basis.

The data processing for the purpose of contacting me is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily given consent.

The personal data collected by me for the use of the contact form will be automatically deleted after the request made by you has been processed.

Disclosure of Data

I host my Website with nexxo GmbH. The provider is nexxo GmbH, Wörthstr. 27 81667 Munich (hereinafter: "nexxo"). When you visit my Website, nexxo collects various log files, including your IP addresses.

The use of nexxo is based on Art. 6 para. 1 lit. f GDPR. I have a legitimate interest in a reliable presentation of my Website. If the appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; consent can be revoked at any time.

I have concluded a contract for commissioned data processing (AVV) with the above-mentioned provider. This is a legally required contract that ensures that this provider processes the personal data of my Website visitors only on my instructions and in compliance with the GDPR.

Other than that, your personal data will not be disclosed to third parties for purposes other than those listed below.
I only disclose your personal data to third parties if:

• You have given your express consent for this in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,

• the disclosure is necessary in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,

• there is a legal obligation for the transfer according to Art. 6 para. 1 sentence 1 lit. c GDPR, and t

• his is legally permissible and necessary for the processing of contractual relationships with you according to Art. 6 para. 1 sentence 1 lit. b GDPR.

Your Rights

You have the right to:

• Request information about your personal data processed by me in accordance with Art. 15 GDPR. In particular, you can request information about the purposes of processing, the categories of personal data processed, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data, if not collected by me, and the existence of automated decision-making, including profiling, and meaningful information about its details;

• request without undue delay the rectification of inaccurate or completion of your personal data stored by me in accordance with Art. 16 GDPR;

• request the erasure of your personal data stored by me in accordance with Art. 17 GDPR, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;

• request the restriction of processing of your personal data in accordance with Art. 18 GDPR if the accuracy of the data is contested by you, the processing is unlawful, but you oppose its erasure and I no longer need the data, but you require it for the establishment, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 GDPR;

• receive your personal data that you have provided to me in a structured, commonly used and machine-readable format or request the transmission to another controller in accordance with Art. 20 GDPR;

• revoke your consent given to me once in accordance with Art. 7 para. 3 GDPR at any time. This will result in me no longer being able to continue the data processing based on this consent in the future, and

• lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your habitual residence or place of work, or my office.

Objection Right

If your personal data is processed based on legitimate interests according to Art. 6 (1) sentence 1 lit. f of the General Data Protection Regulation (GDPR), you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, to the extent that there are reasons arising from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right to object that will be implemented without stating a specific situation. If you wish to exercise your right of revocation or objection, simply send an email to datenschutz@cke.legal.

Data security

During your visit to the Website, I use the common SSL (Secure Socket Layer) protocol in conjunction with the highest level of encryption supported by your browser. Usually, this involves 256-bit encryption. If your browser does not support 256-bit encryption, I fall back to 128-bit v3 technology. You can recognize whether an individual page of my Website is transmitted encrypted by the closed display of the key or lock symbol in the lower status bar of your browser. Furthermore, I employ appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties.
